The National Prosecuting Authority has had a chequered existence since it came into being in 1998, with the last decade in particular exposing the flaws in its legislative and operational framework. ACJR has distilled some proposed key areas of reform which are likely to have multiplier-benefit while maintaining a balance between benefit and achievability in a report titled ‘Recommendations for reform of the NPA’. The authors will discuss and seek comment from participants on these recommendations for reform.

The recommendations relate to appointments and dismissals of senior staff members; transparency and inclusivity; prosecution policy directives around decisions to decline to prosecute senior public officials; the way in which referrals for prosecution from other state agencies are dealt with and reported upon; the handling of informal mediation; the geographical structuring of the NPA; and the accountability of Directors of Public Prosecutions to the National Council of Provinces, and whenever South African Police Service is called to account to provincial legislatures.
