Limits on State Power; Examining the Role of Independent Commissions in Kenya

 In this paper they shall be focusing on the role of these commissions, their constitutional mandates and whether they continue to perform and deliver as expected. They shall also analyse whether there are any overlapping mandates which hinder the effective operations of the commissions. Also argue no absolute limits on state power despite clear provisions in the constitution in respect to the same and this continues to be part of the emerging challenges being experienced by these constitutional commissions and other independent officers.


About Edward Karoph Wabwoto
Edward Karoph Wabwoto is an advocate of the High Court of Kenya with close to 7 years experience in the legal field. He has extensive experience in constitutional, civil, public law and environmental litigation. He has also undertaken several assignments relating to legal and regulatory reform, policy review and development in Kenya. Wabwoto holds an LLB degree from Moi University, A Postgraduate Diploma in Legal Practice and Certificate in Legislative drafting both from Kenya School of Law. He is also a member of the Law Society of Kenya and East African Law Society. He has previously served as a member of the Constitutional Reform Committee and Human Rights/Public interest and Legal Aid Committees of the Law Society of Kenya. He has also worked as a consultant with MUHURI a leading Human Rights organisation in Kenya.


About Eric Opiyo
Eric Opiyo is an advocate of the High Court of Kenya, member of the Law Society of Kenya and East Africa Law Society, Certified Public Secretary CPS (K), and a Member of the Chartered Institute of arbitrators (Kenya).In academia, he holds a Degree in Law (LL.B) from Moi University-Kenya, a Master in Laws Degree (LL.M) from University of Nairobi-Kenya in International Trade and Investments law, a Post Graduate Diploma in Law from Kenya School of law, a Diploma in Forensics and Criminal Investigation as well as a Diploma in Management (Project Management) from Kenya Institute of Management University. He has also completed his MBA from JKUAT University-Kenya and awaits graduation in November 2013.Currently, he has written two essays on Intellectual property, one on international trade law (WTO and EPA/AGOA agreements), International Commercial Arbitration as well as Procurement that awaits publication. As a legal practitioner he is involved in capital markets development and regulation. He is affiliated to Constitutional law, Commercial law, International Investments law, environmental law and Telecommunications law.
