CLC and SARChI chair hosts a judicial dialogue in constitutional cases
A comparative constitutional law discussion on "Judicial dialogue in constitutional cases: the traditions of dissent and concurring judgements in common law and civil law systems" at the UWC’s School of Public Health on Monday, 20 May 2013 in Cape Town.
Judicial dialogue among justices of the South African Constitutional Court produces dissent and concurring judgments with regularity. What is the nature and function of such per curiam judgments and are they confined to the common law tradition? Are there developments of per curiam judgments in the civil law system and, in particular, what is the nature of the recent reforms to the rhetoric of the French courts?
Leading the discussion are Professors Wessel le Roux (UWC) and Xavier Philippe (director of the Louis Favoreu Institute of Public Law and Comparative International and European Law, University of Aix-Marseille).
